يُعد تنزيل برنامج الخطوط أو تثبيته أو استخدامه موافقةً منك على الالتزام بأحكام ترخيص خط ثمانية هذا ("الترخيص"). وإذا لم توافق على هذه الأحكام، فلا يجوز لك تنزيل برنامج الخطوط أو تثبيته أو استخدامه.

الديباجة
تمنح شركة ثمانية للنشر والتوزيع ("الشركة") ترخيصًا محدودًا لاستخدام مجموعة خطوط الثمانية لأغراض التصميم الشخصي والتجاري المنصوص عليها بهذا الترخيص فقط مع حماية سلامة التصميم الأصلي ومنع التوزيع أو التعديل غير المصرح به. لاستثناءات الترخيص أو الحقوق المجاورة أو حالات الاستخدام المخصصة التي لم تذكر بالترخيص صراحةً، نأمل التواصل مع ثمانية على عنوان البريد الإلكتروني [email protected].
التعريفات والتفسيرات
"أنت" يُقصد به الشخص الطبيعي أو الاعتباري، وأي مستخدمين مخولين يعملون نيابةً عنه، يقومون بتنزيل برنامج الخط أو تثبيته أو الوصول إليه أو استخدامه وفقًا لهذا الترخيص، ويشمل التعريف أي تعبير آخر ورد في هذا الترخيص باللغة العربية ويعكس المعنى نفسه.
"برنامج الخط" يُقصد به ملفات خط ثمانية المقدمة من الشركة.
"الأعمال المشتقة" يقصد به أي عمل مبني على برنامج الخط أو متفرع عنه، بما في ذلك التعديل أو التحوير أو إعادة التسمية أو إعادة النشر كخط آخر.
ما لم يقتضِ سياق النص خلاف ذلك: (أ) تكون عناوين الأحكام والبنود لأغراض تنظيمية وتوضيحية فقط ولا تؤثر على تفسير هذا الترخيص؛ (ب) تشمل ألفاظ المفرد الجمع، وتشمل ألفاظ الجمع المفرد؛ (ج) يُقصد بعبارات "يشمل" و"تشمل" و"بما في ذلك" أنها على سبيل المثال لا الحصر؛ (د) تشمل الإشارة إلى أي نظام أو لائحة أي تعديل أو إعادة سنّ أو استبدال لها؛ و(هـ) عند وجود أي تعارض أو غموض، يُفسَّر هذا الترخيص بما يحقق مقصده وغرضه التجاري على أفضل وجه، في حدود ما يسمح به النظام.
الاستخدامات المسموح بها
تُمنح بموجب هذا الترخيص حق غير حصري وغير قابل للتحويل لما يلي:
استخدام برنامج الخط في المشاريع الشخصية.
استخدام برنامج الخط تجاريًا في الشعارات، والهوية والعلامات التجارية، ومواقع الويب، والتطبيقات، والمواد المطبوعة، وأي أعمال تصميم أخرى.
تضمين برنامج الخط في المستندات أو التطبيقات أو المنتجات التي تنشئها.
تضمين برنامج الخط في مواقع الويب أو تطبيقات الويب أو تطبيقات الجوال أو المنتجات البرمجية، وذلك فقط كجزء من منتج مُجمَّع أو مُعبّأ أو مُعَمّى.
الاستخدامات الممنوعة
لا يجوز لك سواءً بطريقة مباشرة أو غير مباشرة:
بيع برنامج الخط أو إعادة بيعه أو تأجيره أو تأجيره تأجيرًا تمويليًا أو ترخيصه من الباطن، بذاته أو كمنتج مستقل.
إعادة توزيع برنامج الخط أو مشاركته أو رفعه أو استضافته أو إتاحته للتنزيل على أي موقع إلكتروني أو خادم أو منصة رقمية أو خدمة مشاركة ملفات. ولا يجوز تنزيل برنامج الخط إلا من الموقع الرسمي لثمانية (https://font.thmanyah.com) واستخدامه على أجهزتك ومشاريعك الخاصة.
إتاحة برنامج الخط بأي طريقة تُمكّن المستخدمين النهائيين أو الأطراف الثالثة من استخراج برنامج الخط أو تنزيله أو الوصول إليه أو إعادة استخدامه أو إعادة توزيعه بشكل مستقل كملفات خطوط، بما في ذلك عبر التضمين على الويب أو التطبيقات أو المنتجات البرمجية.
تعديل برنامج الخط أو تحريره أو تكييفه أو ترجمته أو إجراء هندسة عكسية عليه بأي شكل من الأشكال.
إنشاء أعمال مشتقة أو إعادة نشر برنامج الخط كخط جديد أو مختلف.
إزالة أو تغيير أو طمس أي إشعارات حقوق مؤلف أو علامات تجارية أو علامات تعريفية في برنامج الخط.
ادعاء نسبة التأليف أو نسب الفضل التصميمي أو الملكية لبرنامج الخط، أو تمثيله على أنه عملك.
ولتجنب الشك، يُعد أي استخدام لبرمجية الخط لم يرد نص صريح في هذا الترخيص يجيزه استخدامًا مخالفًا، بما في ذلك — ودون حصر — أي نسخ أو تعديل أو استخراج أو إعادة حزم أو تمكين طرف ثالث من الوصول إلى ملفات الخط خارج نطاق الاستخدامات المسموح بها.
العلامات التجارية والهوية
ثمانية هو اسم وعلامة تجاريتين مرتبطة بالشركة. ولا يمنح هذا الترخيص إذنًا باستخدام اسم ثمانية أو شعارها أو هويتها بأي طريقة توحي بالتأييد أو الرعاية أو الانتماء، باستثناء ما يلزم للتعريف ببرنامج الخط ذاته.
الإخلال والآثار المترتبة عليها
قد يترتب على أي انتهاك لهذا الترخيص - وفق تقدير الشركة - وبما لا يخل بحقوقها النظامية، ما يلي:
مطالبتك بإزالة برمجية الخط وأي استخدام مخالف لها من جميع المواد والمنصات ذات الصلة على الفور; و/أو
إلغاء الترخيص لاستخدام برمجية الخط; و/أو
اتخاذ الإجراءات النظامية اللازمة بشأن انتهاك حقوق المؤلف، بما في ذلك المطالبة بالتعويضات والتكاليف المباشرة وغير المباشرة وأتعاب المحاماة (إن وجدت).
الإنهاء
تعد جميع بنود هذا الترخيص جوهرية ويحق للشركة إنهاء الترخيص فورًا دون مهلة إشعار في حال الإخلال بالأحكام والشروط الواردة به كونه إخلالاً جوهرياً. ولا يخل الإنهاء بحقوق الشركة النظامية في المطالبة بالتعويض أو اتخاذ أي إجراءات نظامية أخرى. كما تتعهد بالتوقف فورًا عن أي استخدام لبرمجية الخط وإتلاف جميع النسخ التي بحوزتك أو تحت سيطرتك.
النظام المعمول به
يخضع هذا الترخيص للأنظمة المعمول بها في المملكة العربية السعودية، وتكون المحاكم المختصة في مدينة الرياض بالمملكة العربية السعودية هي المختصة بنظر أي نزاع ينشأ عنه أو يتعلق به.
اللغة
تكون النسخة العربية هي المعتمدة وتسود على أي نسخة بلغة مترجمة أخرى عند التعارض أو الاختلاف في التفسير.
إخلاء المسؤولية وتحديدها
تُقدَّم برمجية الخط (كما هي وحسب توفرها)، دون أي ضمانات من أي نوع، صريحة كانت أو ضمنية، بما في ذلك ودون حصر: ضمانات القابلية للتسويق، أو الملاءمة لغرض معين، أو عدم الانتهاك، وذلك في حدود ما يسمح به النظام. وتقرّ بأن استخدامك لبرمجية الخط يكون على مسؤوليتك الخاصة، وأن الشركة لا تضمن خلو برمجية الخط من الأخطاء أو انقطاعها أو توافقها مع جميع الأنظمة أو الأجهزة.
لا تتحمل الشركة أي مسؤولية - إلى أقصى حد يجيزه النظام - عن أي أضرار مباشرة أو غير مباشرة أو تبعية أو خاصة أو عرضية تنشأ عن استخدام برمجية الخط أو عدم القدرة على استخدامها، ويشمل ذلك دون حصر فقدان البيانات أو توقف الأعمال أو فوات الربح أو المطالبات من أطراف ثالثة. وفي جميع الأحوال، تُحد مسؤولية الشركة - إن ثبتت نظامًا - بالحد الأدنى الذي يجيزه النظام وبما لا يتجاوز (إن لزم تحديد حد مالي) مبلغ (قيمة الترخيص المدفوع، إن وُجد).
أحكام عامة
يشكّل هذا الترخيص كامل الاتفاق بينك وبين الشركة فيما يتعلق باستخدام برمجية الخط، ويلغي أي مفاهمات أو مراسلات سابقة تتعلق بالموضوع ذاته. ولا يُعتد بأي تعديل أو استثناء على هذا الترخيص إلا إذا كان مكتوبًا وصادرًا عن الشركة.
لا يُعد عدم ممارسة الشركة لأي حق من حقوقها بموجب هذا الترخيص، أو تأخرها في ممارسته، تنازلًا عن ذلك الحق، ولا يمنعها من ممارسة الحق ذاته أو أي حق آخر لاحقًا.
إذا تقرر بطلان أي حكم من أحكام هذا الترخيص أو تعذّر تنفيذه كليًا أو جزئيًا، فلا يؤثر ذلك على صحة باقي الأحكام، وتظل نافذة بقدر ما يسمح به النظام، على أن يُستعاض عن الحكم غير القابل للتنفيذ بحكمٍ أقرب ما يكون للغرض التجاري المقصود منه وبما يتوافق مع الأنظمة.
لا يجوز لك التنازل عن هذا الترخيص أو نقل أي من حقوقك أو التزاماتك بموجبه إلى أي طرف ثالث، سواءً كليًا أو جزئيًا، دون موافقة كتابية صريحة من الشركة.
لا ينشأ عن هذا الترخيص أي علاقة شراكة أو وكالة أو عمل أو تمثيل قانوني بينك وبين الشركة، ويقتصر على منح حق استخدام برمجية الخط وفق الشروط الواردة فيه.
تكون أي إشعارات متعلقة بهذا الترخيص صالحة إذا أُرسلت كتابةً إلى البريد الإلكتروني المعتمد لـ الشركة أو عبر وسائل التواصل الرسمية التي تحددها الشركة، ويُعد الإشعار مستلمًا من تاريخ الإرسال ما لم يثبت خلاف ذلك.
يحق للشركة تعديل هذا الترخيص أو تحديثه من وقت لآخر وفق تقديرها. وتصبح أي تعديلات نافذة اعتبارًا من تاريخ نشر النسخة المحدثة أو إشعارك بها (أيهما أسبق). ويُعد استمرارك في تنزيل أو تثبيت أو استخدام برمجية الخط بعد سريان التعديل موافقةً منك على النسخة المحدثة من الترخيص. ولتجنب الشك، لا يؤثر أي تعديل على الحقوق الممنوحة لك قبل تاريخ سريان التعديل فيما يتعلق بالاستخدامات التي تمت بشكل صحيح قبل ذلك التاريخ، ما لم ينص التعديل
صراحةً على خلاف ذلك وبما لا يتعارض مع الأنظمة المعمول بها.

"Font Software" refers to the thmanyah font files provided by Thmanyah Publishing and Distribution.

“You” or “you” means the individual or legal entity, and any authorized users acting on its behalf, that downloads, installs, or uses the Font Software in accordance with this License.
Unless the context requires otherwise: (a) headings are for convenience only and do not affect interpretation; (b) words in the singular include the plural and vice versa; (c) references to “including” or “include” mean “including without limitation”; (d) references to any law or regulation include any amendment, re-enactment, or replacement thereof; and (e) if any inconsistency arises between provisions, the provision that best gives effect to the commercial purpose of this License shall prevail, to the extent permitted by applicable law.
PERMITTED USES
You are granted a non-exclusive, non-transferable license to:
Use the Font Software for personal projects.
Use the Font Software commercially in logos, branding, websites, applications, printed materials, and any other design work.
Embed the Font Software in documents, applications, or products you create.
Embed the Font Software in websites, web applications, mobile applications, or software products only as part of a compiled, packaged, or obfuscated product.

PROHIBITED ACTIONS
You may NOT:
Sell, resell, rent, lease, or sublicense the Font Software by itself or as a standalone product.
Redistribute, share, upload, host, or make the Font Software available for download on any website, server, digital platform, or file-sharing service. The Font Software may only be downloaded from the official thmanyah website (https://thmanyah.com) and used on your own devices and projects.
Make the Font Software available in any manner that allows end users or third parties to extract, download, access, reuse, or redistribute the Font Software independently as font files, including through web embedding, applications, or software products.
Modify, edit, adapt, translate, or reverse-engineer the Font Software in any way.
Create Derivative Works or republish the Font Software as a new or different font.
Remove, alter, or obscure any copyright notices, trademarks, or identifying marks in the Font Software.
Claim authorship, design credit, or ownership for the Font Software or represent it as your own work.

TRADEMARK AND BRAND USE
“thmanyah” is a name and brand associated with Thmanyah Publishing and Distribution company. This license does not grant permission to use the Thmanyah name, logo, or branding in any manner that suggests endorsement, sponsorship, or affiliation, except as necessary to identify the Font Software itself.

ENFORCEMENT
Violations of this license will result in:
Immediate demand for removal of the Font Software from all materials and platforms.
Revocation of your license to use the Font Software.
Potential legal action for copyright infringement, including damages and costs.

TERMINATION
All provisions of this License are material. The Company may terminate this License immediately, without prior notice, in the event of any breach of its terms and conditions, which shall constitute a material breach. Such termination shall not prejudice the Company’s statutory rights to seek compensation or to take any other legal action. You further undertake to immediately cease any use of the Font Software and destroy all copies in your possession or under your control.

GOVERNING LAW
This license is governed by the laws of the Kingdom of Saudi Arabia. Any disputes will be resolved in the courts of Riyadh, Saudi Arabia.

LANGUAGE
In the event this license is translated into another language, the Arabic version shall prevail.
